Non Creamy layer certificate
I joined in Kerala State Governemnt service as Class III employee in the year 1990. In the year 2010 I promoted as Class II employee. My wife is also in State Government service. She is also a Class III employee. Our total income in the financial year 2009-2010 was below Rs.400000/-. Next financial our total income exceeds Rs.450000/-. Hence for clarification whether my daughter will get a non-creamy layer certificate. If so what are the steps to be taken to get the same. Kindly inform how to get the order stating the section of employees come under non creamy layer.

Though income limit of non creamy layer has been increased from 2.5 lacs to 4.5 for the salaried persons but as per the government organisations which issue Certificate for OBC Non Creamy Layer Certificate,they are having no information regarding the same.
As per them they have not received the new limit notification from the concerned autority & they are considering the limit of 2.5 lacs only.

Where is the GOI Order for OBC new non-creamy layer?
Now December has come but no GOI order/memorandum in r/o new OBC beneficiaries (Rs.4.5 lakhs) has yet been issued or I don't know whether it is issued yet. How do I know that GOI has issued the same in this respect.

First of all I thank to UPA government & officers for hiked the income criteria of OBC CREAMY-LAYER frome 2.5 lakh to 4.5 lakh. But GOVERNMENT ORDER did not publish in government website and did sent to government offices. Due to non availability of govt order revenue officers do not give the OBC certificate.I HAVE TRIED MY BEST TO GET THE OBC CERTIFICATED FRO THE LAST 25 DAYS WITH NO RESULT I THINK THE GOVT. IS TRYING TO CHEAT THE PEOPLE IN VIEW OF THE FORTHCOMING ELECTIONS.
Issuance of GOI order/memorandum in respect of new ceiling of OBC creamy layer hike to Rs. 4.5 lakhs is urgently necessary so that the beneficiaries those who will appear this year's AIEEE/IIT-JEE may be benefited. Please look into the matter sympathetically so that the govt. of India's order is issued immediately within this month otherwise the application for OBC certificate is not being received by the concerned department.
From the above report, it is clear that the creamy layer has been hiked from 2.5 lakh to 4.5 lakh, thanks to the govt.It is already nine months that the above note is published even though the govt department had not got any gazetted orders so the revenue officers are not issuing any certificate.
So please publish the G.O for revised income criteria for OBC certificate. Then only the people who are waiting for the job can enjoy the real use of this plan.

but at the last step of issuing that certificate, the officer refused to give me OBC certificate and said that they did not get the government order of the revised creamy layer limit to Rs. 4.50 lakh per year from 2.50 lakh. Please pass your govt order to all related offices.

Thanks for taking issue like OBC reservation. I am studying in OBC matters, especially in creamy-layer since 15 years. The main reason for lying seats vacant is eligible OBCs are not getting caste certificate due to misinterpretation of creamy layer criteria regarding government servants. As per the creamy-layer criteria issued by Government of India DOPT O.M. No.36012/22/93-Est. (SCT) dated 8.9.1993 (also adopted by Supreme Court for recent 27% obc reservation in higher educational institutes in their judgment of writ petition (Civil) no. 265/2006 available on www.ncbc.nic.in then click office memorandum) following important point is misinterpreted due to which whole country is confused including OBCs and authorities issuing the caste certificate.
NORMALLY AN OBC CANDIDATE HAVING PARENT’S SALARY INCOME ABOVE RS.4.50 LAKH DONT TRIES TO GET OBC NON-CREAMYLAYER CASTE CERTIFICATE, WHICH IS TOTALLY A WRONG CONCEPT.
(1) Actually the creamy-layer limit of Rs. 4.50 lakhs is not applicable to “government servant’s salary income” and “farmer’s agricultural income”. It is the creamy-layer limit for “business income” only. As the government servants are to be checked by their post held and farmers by their land holdings hence can not be checked by salary/agricultural income.
(2) In rule- (6) showing creamy-layer limit of Rs.4.50 lakhs the GOI already given the following explanation- “Income from salaries or agricultural land shall not be clubbed with income” because there is a separate rule number (2) & (3) provided on the basis of post held meant for salaried persons & a separate rule number (5) is provided for persons holding agricultural land.
(3) The criterion (2) & (3) clearly speaks that only the following “government servants” will be treated as creamy-layer.
(i) Parents, either of whom is a Class I officer. (Direct Recruitment)
(i) Parents, both of whom are Class II officers. (Direct Recruitment)
(iii) Parents of whom only the husband (father) is a Class II officer and he gets into Class I at the age of 40 or earlier.
(iv) In military, colonel and above.
Note- Other than the above 4, entire OBC government servant of the country will not fall under creamy-layer.
(4) The criteria (5) clearly speak that only following “farmers” will be treated as creamy-layer.
(i) Families having, only irrigated land which is equal to or more than 85% of the statuary ceiling area.
(ii) The rule of exclusion will not apply if the land holding of a family is exclusively un-irrigated.

CREAMY LAYER LIMIT RAISED TO 4.50 LAKHS:
Thanks to Government of India for revising creamy layer limit to Rs. 4.50 lakhs per year for clause (06) of creamy layer criteria dated 08.09.1993 applicable mainly to OBC’s business income only.
A separate limit of Rs. 10 lakhs per year should be declared for employees working in private sector/employments. They should also revise the other clauses of creamy layer criteria dated 08.09.1993 and persons promoted to class-I post after the age of 30 year instead of 40 year, class-II marrying a class-II lady, class-I selected through State PSCs should also be excluded from creamy layer and must be extended the benefit of reservation for their sons and daughters.
