SHRC orders Rs 2 lakh compensation to Bihar Dalit

The state police had illegally detained him after his acquittal by the court in a case

Patna: The State Human Rights Commission (SHRC) of Bihar has ordered the government to pay Rs two lakh as compensation to a Dalit, who was put under illegal detention by the police.

The rights panel also passed strictures against the judicial magistrate of Danapur sub-divisional court and the local police for violation of human rights.

While disposing of a petition filed by Lal Bahadur Manjhi, a resident of Bikram in Patna rural, a division bench comprising SHRC Chairman Justice S N Jha and Member Rajendra Prasad said the amount should be paid to the complainant.

The Commission, however, gave liberty to the government to realise the amount from the accused persons. The Commission, in its order, expressed shock over the detention of the complainant for three months despite his acquittal in the case.

Manjhi, in his complaint, had alleged that he was arrested by the police in Bikram police station case number 113/98 and produced in the court on May8, 2005. The court remanded him to judicial custody. On February21, 2008 the parties filed a compromise petition.

The court took cognisance and acquitted Manjhi of the charges on April 10, 2006. Manjhi, however, was re-arrested in the case on December 22, 2009 and produced in the court.
